MOFCOM: To review the anti-dumping measures on carbon steel fasteners from the EU and the UK

The Ministry of Commerce announced on June 28 that it decided to review the anti-dumping measures applied to imports of carbon steel fasteners from the European Union and the United Kingdom from June 29, 2021.
According to the announcement disclosed, on June 28, 2010, the Ministry of Commerce issued Notice No. 40, 2010, decided to impose anti-dumping duties on imports of carbon steel fasteners originating from the European Union, with the tax rate ranging from 6.1% to 26.0%.On June 28, 2016, the Ministry of Commerce issued Announcement No. 24, 2016, deciding to impose anti-dumping duties on imports of carbon steel fasteners from the European Union starting from June 29, 2016 at the rate announced in Announcement No. 40, 2010, and the period of implementation is 5 years.On September 19, 2017, the Ministry of Commerce (MOFCOM) issued Notice No. 50 of 2017, adjusting the anti-dumping duty rate on imports of carbon steel fasteners from Royal Nedschroff Holdings Limited and its affiliated companies from 26.0% to 5.5%.
On January 29, 2021, the Ministry of Commerce issued Announcement No. 3 of 2021.According to the notice, after the end of the Brexit transition period on 31 December 2020, the trade remedy measures previously applied to the EU will continue to apply to the EU and the UK for the same period of time.New trade remedy investigation and review cases initiated by the EU after this date will no longer involve the UK as a member of the EU.
On April 28, 2021, MOFCOM received the application for review of the anti-dumping measures submitted by the Fastener Branch of China Machinery General Parts Industry Association on behalf of the carbon steel fastener industry of China.The applicant claims, in case of termination of anti-dumping measures, import carbon steel fasteners originating in the eu and the UK dumping may continue, the damage to the Chinese industry is likely to continue, the request to the Ministry of Commerce for import carbon steel fasteners originating in the eu and the UK for final review, and maintain the import carbon steel fasteners originating in the European Union and Britain on the implementation of anti-dumping measures.
In accordance with Article 48 of the Anti-dumping Regulations of the People’s Republic of China, the Ministry of Commerce has decided to conduct a review of the anti-dumping measures on imports of carbon steel fasteners from the European Union and the United Kingdom as of June 29, 2021.
According to the statement, the Tariff Commission of the State Council has decided that during the review of anti-dumping measures,Anti-dumping duties on imports of carbon steel fasteners from the European Union and the United Kingdom will continue to be imposed in accordance with the range of products and the tariff rates announced in Announcement No. 40 of 2010, No. 24 of 2016, No. 50 of 2017 and No. 3 of 2021 of the Ministry of Commerce.
The dumping investigation period for this review is January 1 BBB 2020 and December 31 2020, and the industry injury investigation period is January 1 BBB 2016 and December 31 2020.
The scope of products under review is the same as that of the Ministry of Commerce Announcement No. 40 of 2010.The product under investigation, named Certain Iron or Steel Fasteners, consists of wood screws, tapping screws, screws and bolts (whether or not with nuts or washers, but excluding screws used to fasten rails and screws and bolts of a rod diameter not greater than 6 mm) and washers.The products under investigation do not include nuts or fasteners used in maintenance and repair of civil aircraft.
The review examines whether termination of the anti-dumping measures on imports of carbon steel fasteners from the European Union and the United Kingdom may lead to the continuation or recurrence of dumping and injury.
